President Thomas J. Murawski and the Board of Trustees of the Village of Midlothian, Cook County, Illinois, met in regular session in the Council Chambers on September 26, 2007. The pledge to the flag was made. The meeting was called to order at 7:30 p.m.

President’s Business

Back To School Campaign

Metra hosted a contest for drawings depicting rail safety. Calendars of the winning entries will be distributed to all communities. One of the winners of the contest is from Midlothian.

Net 8 Update

The Urban Area Technology Committee approved funds for Net 8 communities. A contract for the Net 8 Communication Network will be signed either October lst or November 1st.

IEPA Report

The Village is in receipt of the annual IEPA report of the Village water distribution system. A recommendation of education to the public at a later date was made.

West Nile Virus

Cook County reported a decrease in West Nile Virus flu cases. Twelve cases were reported in the County with one death. President Thomas J. Murawski urged everyone to rid their property of any stagnated water.

Promotions

Radio dispatchers Ryan Gulli and Anthony Tavormina were promoted to part-time police officer status as of September 14th.

Bike Path

A request and recommendation to pay Matthews Paving, Inc. $80,800 for completed work on the Bike Path spur was made.

The work was completed by grants through Senator Emil Jones and State Representative Bob Rita, but to date, no money has been received from the State.

143rd Street Paving

In a letter from Superintendent John Hansen, the Village of Crestwood was notified of their share of the cost of paving 143th Street, Tripp to Keeler. The original estimate was $14,300, but the actual cost was $10,458.75. Superintendent Hansen said payment had already been received.

Mid Oaks Plaza

The Village was updated on the status of the relocation of the Walgreen’s in the Mid-Oak Plaza and the pending demolition permit from the County. The demolition permit is only good for 20 days.

Cable Service

AT & T is filing a formal application through the Illinois Commerce Commission with the State of Illinois for cable service approval. The Village is to grant permits for installation of fiber optics.

Birthday Card

American Business Women’s Association (ABWA) Libra Chapter wished the Village a Happy 8oth Birthday. A parade on Saturday will step off at 10 a.m. for the Scottish Fair. An invitation was extended to all.

Emergency Services and Disaster Agency (ESDA) has received a donation of a lighting unit. The title of the unit was presented to the Village to become part of its equipment.

Public Relations Coordinator Gladys Schuler reported on the following:

The Village Open House and 8oth Birthday Party will be on Sunday under the tent on the Village green. There will

face painting and the Castle Jump for children, exhibits from the Park District and Library, in addition to some local

businesses. Food will be available.

Fire Chief William “Bill” Sheehy III said that they will have a fire burn cell demonstration at 1 :30 p.m. Fire Prevention Week is October 7 through 13. This year’s theme is “Practice Your Escape Plan”. The Fire Department Pancake Breakfast will be on Sunday, October 14th, 8 a.m. to 1 p.m.

Village Board Meeting Minutes for July 25, 2007

Public Hearing

Pursuant to a legal notice published in the Midlothian-Bremen Messenger, President Thomas J. Murawski announced that he would open a public hearing on the Appropriation Ordinance. President Thomas J. Murawski asked for comments from the public. There were none.

The clerk’s office had no correspondence.

Trustee Karen Kreis had questions that were answered earlier by Treasurer Denise Borne.

President Thomas J. Murawski entertained a motion to close the public hearing.

All ayes.

The public hearing portion of the meeting was closed.

Lawsuit Settlement

A lawsuit filed against the Village by Martin Varasanec was set for trial earlier today. President Thomas J. Murawski had authorized the Village attorney to settle out of court pending approval of the Village board.  The settlement would be approximately one third of the original lawsuit amount. Attorney J. Daniel McGrath was thanked for negotiating the terms of the settlement.

Cable Update

In order to create competitive cable service throughout the State of Illinois, our State legislators approved Project Light Speed. Thanks to the Illinois Municipal League (IML), the Metropolitan Mayors Caucus (MMC), the City of Naperville, State of Illinois Attorney General Lisa Madigan that jointly got the original bill changed to protect municipal rights of way and consumer rights.

AT & T will install fiber optics. The location of their equipment to be installed throughout the community is still under discussion. A workshop meeting is to be held on August 16th at South Suburban Mayors and Managers Association headquarters. Their permit is pending.

Eligibility List

The Police and Fire Commission has sent letters to five candidates from the most recent eligibility list for an offer of employment as probationary police officer. Their responses are pending.

Bike Path

Robinson Engineering reported that a pre-con meeting was held on July 12, 2007 for the Bike Path project. Work is underway. President Thomas J. Murawski thanked State Representative Rita and Senator Jones for their help in securing the necessary funds.

Paving

143rd Street from Tripp to Keeler is part of the 2007-8 MFT Resurfacing program. Only half of the street belongs to Midlothian. Crestwood asked that their half of the street be paved and they would reimburse Midlothian $14,300.00, the cost of their half of the street.

RTA

The Village’s copy of the executed amendment of Phase II to the Technical Services agreement between the RTA and the Village has been received. The contract is extended from June 30, 2007 to December 31, 2007.

Pre-Con Meeting

A pre-con meeting on the 2007-8 MFT Resurfacing Program was held on July 11, 2007.

IEPA Notice

A violation for not submitting a monitoring form for lead and copper by July 10th was rescinded when Joe Sparrey produced a certified letter receipt that the form was sent in on time.

Intergovernmental Agreement

The Park District has asked for changes in an intergovernmental agreement to allow for a detention pond and a 25-year lease of 1 45th street for parking area changes.

President Thomas J. Murawski entertained a motion authorizing the Village attorney to contact the Park District or their attorney for the possible leasing of 145″‘ street from Kilbourn to Kostner.

Right Of Way Ordinance

A request from the Metropolitan Mayor Caucus to pass a right of way construction ordinance to conform with Cable and Video Competition Law was made. The Village of Midlothian had previously passed a similar ordinance in 1999.

ESDA Update

President Thomas J. Murawski thanked ESDA Chairman Mike Tryon and his staff for their extraordinary work in assisting the police and Fire Departments. They have volunteered over 164 hours. In addition, they most recently have assisted with Thunder Over Midlothian, St. Christopher’s Fiesta and assisted Mokena.

Alternative Revenue Bond

Deputy Clerk Betty Schaefer read an ordinance authorizing the issuance of General Obligation Bonds (Alternate Revenue Source) in an aggregate principal amount not to exceed $2,750,000.00.

President Thomas J. Murawski entertained a motion to suspend the rules of procedure to adopt an ordinance.

Appropriation Ordinance

President Thomas J. Murawski polled the Board as to whether they were ready to take action on the appropriation ordinance.

Deputy Clerk Schaefer read an ordinance providing appropriation for corporate purposes for fiscal year beginning May 1, 2007 and ending April 30, 2008 with $17,924,697.00 to be appropriated and $1,523,424.00 to be raised by tax levy.

Deputy Fire Chief Art Vandergrift will be retiring November 27, 2007

Underage Drinking

President Thomas J. Murawski referred to the recent arrest, arraignment, and guilty verdict of Deerfield residents Mr. & Mrs. Hutsal who allowed underage drinking in their home. He reminded parents that they should be parents rather than their children’s friend.

TJM Charity Golf Outing

President Thomas J. Murawski thanked TJM Charity Golf Chairman Jim Connell, William Sheehy, Vince Schavone, Rick Hansen and their team for another successful fundraising event. Humanitarian Awards were presented to Jack Lanigan, Sr. of Mi-Jack, Tom Wappel of Bud’s Ambulance and Tom Woodlock of Sentry Foods.

I Can

Bremen High School’s “I CAN” drive recently donated $375.00 to the Mike Papineau Fund and an additional $75.00 was collected in a tip can at the Fiesta beer booth that was also be contributed to the fund.

President Thomas J. Murawski and the Board of Trustees of the Village of Midlothian, Cook County, Illinois met in regular session in the Council Chambers on April 25, 2007. The pledge to the flag was made. The meeting was called to order at 7:30 p.m.

At the last Safety Committee meeting, a recommendation was made to post additional directional parking signs around Belly Button Hill and also a sign directing overflow cars to parking at the pool and soccer field.

President’s Business

Pre-Con Meeting

The Illinois Department of Transportation (IDOT) will be conducting a pre-con meeting on May 4, 2007 regarding the 2.7 miles of milling and resurfacing to be done on 147th Street. The estimated starting date for the project is May, 2007 with a projected completion date of August, 2007.

Robinson Engineering

A request and recommendation to pay National Power Rodding $30,118.99.00 for work completed on the 2006 Sanitary Sewer Maintenance Program was read.

President Thomas J. Murawski entertained a motion to pay the bill when funds become available.

A request and recommendation to pay Robinson Engineering $260.00 for reservoir inspection, $520.00 for the Water Capital Improvement Plan, $4,587.75 for Storm Sewer Atlas, and $1,284.00 for miscellaneous engineering.

Franchise Fee

The Village received a franchise fee of $34,700.51 from Comcast, 5% of the $694,010.25 gross revenue for January 1, 2007 through March 31, 2007.

Bank Qualified Bonds

A request from neighboring South Holland to transfer $4 million of our $10 million bank qualified bonding power to their community was read. Midlothian would receive a $5,000.00 fee for the service without any liability.

President Thomas J. Murawski entertained a motion to become a conduit community to transfer $4 million in bonding power for one year and accept the offer of $5,000.00 from South Holland.

Parents Beware

The Mayor warned parents to beware and think that they are their children’s friends by permitting underage drinking of alcohol beverages in their home. President Thomas J. Murawski read a copy of a letter that was mailed to a resident regarding underage drinking that had taken place at his home. The Mayor stressed a “word to the wise” that the Village is looking for compliance, not prosecution.

Property Tax Stamp Ordinance

President Thomas J. Murawski reiterated the fact that the property tax stamp ordinance was passed at the last Board meeting.

Again, the Village is looking for compliance of paid bills and installation of smoke and CO detectors with the sale of property in the Village.

Health Center

CVS Pharmacy has proposed a Health Center to be available in their Midlothian location. It would be staffed by a nurse practitioner under the supervision of a medical director. Patients would be treated for minor ailments and insurance will be accepted. Plans have been submitted to the Building Department for review and permits.

Spring In Midlothian

President Thomas J. Murawski along with several of the trustees attended opening ceremonies of Midlothian Baseball the past weekend. He thanked the Knights of Columbus and the parents for all their work.

President Thomas J. Murawski publicly thanked Representative Bob Rita for taking the initiative to lead and host a recent meeting with Illinois Department of Transportation on the proposed Interstate 57 and Interstate 294 interchange east of Kedzie to and from 147th Street.

Budget

Public Works is the first department to submit their annual budget.

Fire & Police Commission

A letter of recommendation from the Fire and Police Commission to offer a position of probationary police officer to Timothy E. Shaugnessy was read.

Swearing In

Clerk Michael “Mike” Woike swore in Timothy E. Shaugnessy as probationary police officer. He was pinned by his mother while his father looked on.

Request to elaborate on installation of new signs at Park. President Thomas J. Murawski noted that more lighting is needed to deter vandalism.

Clean-Up Day is scheduled for May 19th. In support of Clean Air Counts, the Village will be doing a gas can exchange along with a gas lawn care buy-back program. There will also be a collection of old cell phones and old computers that will be recycled.

For Trustee Michael “Mike” Papineau: A request and recommendation for a partial disbursement of grant money for the purchase of 30 sets of firefighter boots at a cost of $7,125.00. The Village’s share $375.00 + $475.00, $950.00. The total cost is $7,975.00.

President Thomas J. Murawski entertained a motion to accept and proceed with the grant.

A request and recommendation to pursue the purchase of 10 in-car printers at $749.00 each for a total of $7,490.00 and 10 brackets at $99.00 each plus $128.80 through a reimbursable grant was read.

MARS Day is May 5, 2007

Building Superintendent Jim Connell reported on the following:

Compliment to Public Works on a great job handling the flooding in town and reminded residents to bring in their garbage cans after pick-up or they will be ticketed.  Also warned residents that they need to read the directions when they purchase space heaters and not place them on carpeted areas.  He thanked the Fire Department for their quick response to a recent fire caused by a space heater.

President Thomas J. Murawski added this may be Trustee’s Frances Verble last Board meeting and thanked her for many years of dedicated service to the Village.

The vote canvass is to be done by Cook County and supposedly will be available on May 8th.
